Die Kosten einer Untersuchung tr\u00e4gt der Mieter.<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">4.2 Bei \u00dcberlassung erkennbare M\u00e4ngel, welche den vorgesehenen Einsatz nicht unerheblich<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">beeintr\u00e4chtigen, k\u00f6nnen nicht mehr ger\u00fcgt werden, wenn sie nicht unverz\u00fcglich nach<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">Untersuchung schriftlich gegen\u00fcber dem Vermieter angezeigt worden sind. Sonstige bereits bei<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">\u00dcberlassung vorhandene M\u00e4ngel sind unverz\u00fcglich nach Entdeckung schriftlich anzuzeigen.<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">4.3 Der Vermieter hat rechtzeitig ger\u00fcgte M\u00e4ngel, die bei \u00dcberlassung vorhanden waren, auf eigene<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">Kosten zu beseitigen. Nach Wahl des Vermieters kann er die Beseitigung auch durch den Mieter<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">vornehmen lassen; dann tr\u00e4gt er die erforderlichen Kosten. Der Vermieter ist auch berechtigt,<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">dem Mieter einen funktionell gleichwertigen Mietgegenstand zur Verf\u00fcgung zu stellen, falls dem<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">Mieter dies zumutbar ist. Die Zahlungspflicht des Mieters verschiebt sich bei wesentlichen<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">Beeintr\u00e4chtigungen des Mietgegenstandes um die Zeit, in der die Tauglichkeit zum<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">vertragsgem\u00e4\u00dfen Gebrauch aufgehoben ist. F\u00fcr die Zeit, w\u00e4hrend der die Tauglichkeit<\/span><\/p><\/div><div style=\"caret-color: #212121; color: #212121; font-family: Aptos;\"><p style=\"margin: 0cm; font-size: 11pt; font-family: Calibri, sans-serif;\"><span style=\"font-size: 12pt; font-family: Aptos; color: black;\">gemindert ist, hat der Mieter nur eine angemessen herabgesetzte Miete zu entrichten.
